These Terms of Sale apply to all purchases made through the Dan Mackenzie Client Gallery Print Store (gallery.danmackenzie.co.uk) and supplement our Terms of Service and Privacy Policy. By placing an order, you agree to be bound by these Terms of Sale along with our main Terms of Service and Privacy Policy.
1. Scope
These Terms apply to:
- Purchases of digital downloads or print products through gallery.danmackenzie.co.uk
- All payment, fulfilment, delivery, returns and refund procedures for these transactions
- Note: These do not cover photography sessions, consulting, or other services (see our main Terms of Service)
2. Purchasing, Payments & Order Acceptance
2.1 Order Placement
Orders are placed and paid for directly on the Client Gallery Print Store. You must be at least 18 (or have parental/guardian approval) to place an order.
2.2 Payment
Full payment is due at checkout using approved payment methods (Stripe, major credit/debit cards). No card/payment details are stored by us—handled exclusively via Stripe.
2.3 Order Acceptance
Orders confirmed upon payment but may be cancelled or refused for errors, fraud prevention, unavailability, policy violation, or at our discretion. Cancelled orders refunded in full within 14 business days.
3. Fulfilment & Delivery
3.1 Print Products
Fulfilled by professional partner labs. Production times typically 5–10 business days post-payment. Orders cannot be changed or cancelled once submitted, as all prints are custom-made.
3.2 Digital Downloads
Available instantly after purchase. Must be downloaded within the timeframe detailed at purchase. Keep copies securely—no replacements for downloads after expiry, except for technical faults reported within 7 days.
4. Shipping, Returns & Refunds
4.1 Print Orders
Shipped by professional labs subject to their timelines. Shipping cost calculated at checkout. International orders: you are responsible for import duties/taxes.
4.2 Lost/Damaged Orders
Notify support@danmackenzie.co.uk within 7 days of receipt for damaged, incorrect, or defective items to arrange resolution or replacement.
4.3 Digital Product Sales
All digital image/download sales are final. Refunds only if files are corrupted/undeliverable (notify within 7 days).
4.4 No Returns for Custom Prints
Custom prints are non-returnable for change of mind or preference. Colour variation due to device or material does not qualify as a defect.
4.5 Refund Processing
Approved refunds processed to original payment method within 14 business days.
5. Licensing & Copyright
5.1 Personal Use
Digital downloads/prints sold via the Print Store grant a non-exclusive, non-transferable personal use license. Commercial use is prohibited unless a separate license is agreed in writing.
5.2 Copyright
All copyright remains with Dan Mackenzie Creative. Use of images for marketing/business requires written permission.
6. Data Protection, Security & Privacy
6.1 Data Use
Purchase and contact details are collected only for order processing and managed per our Privacy Policy. Payment handling via Stripe.
6.2 Third Parties
Data may be shared with fulfilment partners, payment processors, and shipping carriers strictly for order fulfilment. We do not sell personal data.
7. Legal Compliance & Jurisdiction
UK Law: These Terms comply with UK Consumer Rights legislation. Disputes are handled first via informal resolution (contact support@danmackenzie.co.uk), or escalate to mediation or courts in England and Wales if unresolved.
8. Updates & Contact
8.1 Changes
Terms of Sale may be updated. Material changes are posted at danmackenzie.co.uk/terms-of-sale, with the effective date shown. Continued use signifies acceptance.
8.2 Support
Contact support@danmackenzie.co.uk for assistance or order questions. Include order number, issue, and if applicable, photos of defective items.
